1. The agreement

These Terms of Service (“Terms”) govern your use of trymaximize.com and the services provided by Maximize (“Maximize,” “we,” “us”), based in Lehi, Utah and serving clients nationwide.

If you are a Maximize client, your agreement with us consists of: (a) these Terms, (b) your service agreement or order with us (which controls if it ever conflicts with these Terms), and (c) our Privacy Policy, which is incorporated by reference.

By using this site or the services, you agree to these Terms. If you don’t agree, don’t use the site or services.

2. The services

Maximize provides services to owner-operated businesses, principally:

• Maximize Marketing — websites, Google Business Profile work, reviews, and related marketing.

• Maximize Calls — call handling, missed-call text-back, texting, and booking support.

• Maximize Payments — payment acceptance services, including statement reviews, card processing setup, text-to-pay, and recurring billing.

• Maximize Maintenance — ongoing care, updates, and support for the above.

Service details, deliverables, and pricing for your business are set out in your service agreement. Features may evolve over time; we will not reduce a service you are paying for without notice.

3. The free statement review

The statement review is free and creates no obligation. You send us a processing statement; we prepare a side-by-side comparison; you decide whether to switch anything. Our comparison is based on the statement you provide and the pricing available to us at the time — it is an estimate for comparison, not a guarantee of future rates, which can change under §4.

4. Payments and processing

Card processing is provided through our payment processing partner, and your processing activity is also subject to the partner’s terms, the card networks’ rules, and applicable law — which will be provided to you when you enroll in processing. Rates and fees for processing are set out in your processing enrollment documents. If processing terms ever conflict with these Terms regarding processing activity, the processing documents control for that activity.

You are responsible for the accuracy of the transactions you submit, for handling your customers’ payment disputes and chargebacks as the merchant of record, and for complying with card-network rules that apply to your business.

5. Fees, term, and cancellation

Fees for subscription services are set out in your service agreement. Our standard Growth System terms are a $2,500 setup fee and $1,000 per month, with a 3-month minimum, then month-to-month. Processing fees, where applicable, are separate and set out in your processing documents.

Either party may end a month-to-month service as provided in the service agreement. Fees already paid for the current period are not refundable except as required by law. At the end of services, we will make your business content and data available to you as described in your agreement; websites and content created for you are handled as set out there.

6. Your responsibilities

You agree to: provide accurate business information; use the services lawfully; maintain permission to contact your customers before messages are sent to them through Maximize Calls (you are responsible for the content and the recipients of messages sent on your behalf); and keep your account credentials confidential. You are responsible for activity under your account.

7. Acceptable use

Don’t use the services to send spam or unlawful messages, infringe anyone’s rights, interfere with the services or our systems, or misrepresent your business to your customers. We may suspend services for violations, with notice where practical.

8. Intellectual property

We own the Maximize name, site, and materials we create for our platform. Your business name, trademarks, and the content you provide remain yours. You grant us the limited rights needed to operate the services for you (for example, displaying your content on your website and in your marketing materials).

9. Disclaimers and liability

The services are provided “as is.” We work to keep them accurate and available, but we don’t warrant uninterrupted operation or specific business results — no marketing or payments provider can honestly guarantee revenue, rankings, or savings beyond what your own signed comparison shows. To the extent permitted by law, our total liability arising from the services is limited to the amounts you paid us in the three months before the claim, and neither party is liable for indirect or consequential damages.

10. Governing law

These Terms are governed by the laws of the State of Utah, and any dispute will be resolved in the state or federal courts located in Utah, unless your service agreement says otherwise.

11. Changes to these Terms

We may update these Terms from time to time. The current version lives on this page with its date; material changes will be communicated to clients directly. Continued use after a change takes effect means you accept the updated Terms.
